HYGIENE - Guidance for Enforcement Authorities and Food Businesses on Regulation (EC) No 852/2004, Annex I regarding the Use of Private Water Supplies in Primary Production

The Food Standards Agency (FSA) has produced a guidance document to assist local authorities and food business operators in relation to the use of private water supplies during primary production operations on farms. This explains the legal requirements regarding the safe use of water during certain primary production activities as set out in Regulation (EC) No 852/2004.

This guidance document has been developed in consultation with the four FSA Offices in England, Scotland, Wales, Northern Ireland and the Drinking Water Inspectorates. This consultation covers England and Wales, and similar consultations are taking place in Northern Ireland and Scotland.

This guidance provides clarity on the law. The FSA does not envisage that the introduction of this guidance will have any impact in terms of cost on food businesses or enforcement authorities, as the guidance simply explains the legal requirements in relation to the use of private water supplies set out in Regulation (EC) No 852/2004.

The consultation will last for 12 weeks, so comments are required by 18 February 2015.

This consultation seeks comments from enforcement authorities and food business operators on proposed guidance on the use of private water supplies in primary production in relation to Regulation (EC) No 852/2004.

What is the purpose of this consultation?

 The FSA is inviting comments from enforcement authorities and food business operators on its guidance document on the use of private water supplies in primary production in relation to Regulation (EC) No 852/2004.

Consultation details

Annex I, Part A, 4(d) and 5(c) of Regulation (EC) No 852/2004 requires that food business operators rearing, harvesting or hunting animals or producing primary products of animal origin, and producing or harvesting plant products, respectively, are to take adequate measures to use potable, or clean water, whenever necessary to prevent contamination. This guidance has been produced to assist enforcement officers and food business operators determine use of appropriate water supplies in primary production operations on farm.

The scope of this guidance is restricted to the use of clean water in primary production activities that are within the scope of Regulation (EC) No 852/2004.
