Draft Commission Regulation Setting Maximum Levels For Certain Contaminants In Foodstuffs: Proposed Limits For 3-MCPD

This letter was to particularly draw attention to the provisions for 3-monochloropropane-1 ,2-diol (3-MCPD).

In the UK, the Food Advisory Committee has recommended that industry should take all steps to ensure that 3-MCPD is undetectable (i.e. less than 0.01 mg/kg) in foods and, where technologically feasible, in food ingredients as well. This voluntary limit has been introduced in the absence of any BU-wide limits for 3-MCPD in foodstuffs.

The current proposal sets a maximum level of 0.01 mg/kg for the following foodstuffs

It is intended that these limits should apply to the foodstuffs as consumed and not to any of their constituent ingredients. However, there is currently some ambiguity regarding the wording of Article 2.4 which will need to be addressed during discussions.

This proposal is due to be discussed at the next meeting of the Contaminants Working Group on 17 December.
