Purpose of the call for evidence

Stakeholder responses will inform FSA and FSS advice to the Department for Business and Trade that will contribute to the UK Government report (required under Section 42(2) of the 2020 Agriculture Act) as part of the Parliamentary scrutiny process for this Free Trade Agreement (FTA).

Details of call for evidence

The Food Standards Agency and Food Standards Scotland (FSA and FSS) seek stakeholder views on whether and to what extent provisions in the Comprehensive and Progressive Trans-Pacific Partnership (CPTPP) (Opens in a new window) that relate to trade in agricultural products may affect the maintenance of UK statutory protections for human health, in line with FSA and FSS remit which covers food safety and nutrition.

Please note that, in accordance with the commissioning letter from the Secretary of State for Business and Tradeto the FSA and FSS [see text below], submissions should not address animal or plant life or health; animal welfare; and environmental protections as these areas will be assessed by the Trade and Agriculture Commission.

Evidence required

Textual evidence on whether and to what extent the measures applicable to trade in agricultural products in CPTPP are consistent with the maintenance of UK levels of statutory protection in relation to food safety and nutrition.

Letter from Secretary of State Kemi Badenoch to the Chairs of the Food Standards Agency and Food Standards Scotland requesting formal advice on the UK-CPTPP accession agreement

Dear Professor Jebb and Mrs Kelman,

As the UK’s Food Safety Authorities, I am writing to request joint advice from the Food Standards Agency (FSA) and Food Standards Scotland (FSS) on the UK’s agreement to join CPTPP, in line with the provisions of section 42 (4) of the Agriculture Act 2020 (“S.42”). Specifically, to request your advice on whether, or to what extent, the measures in the agreement – as signed on 16 July 2023 in New Zealand – are consistent with the maintenance of UK levels of statutory protection in relation to human health.

In producing your joint advice, I would request that the FSA/FSS focus on the areas within their statutory remit in the context of the relevant chapters of the agreement.

I would like to request that this advice be produced as an annex to be attached to the Government’s S.42 Report, and submitted electronically to the TAC mailbox (TACSecretariat@trade.gov.uk) by no later than 30 November 2023.
