Summary module description:
This module aims to provide students with a knowledge and understanding of the legal principles governing the law of contract use, enjoyment and transfer and leasehold land and to set these in their practical and commercial context

This module aims to provide students with a knowledge and understanding of the legal principles governing the law of contract use, enjoyment and transfer and leasehold land and to set these in their practical and commercial context


Assessable learning outcomes:
Students will be able to
- demonstrate a practical understanding of the basic principles of the law of contract
- enumerate and understand the principal liabilities undertaken between landlords and tenants;
- explain and appreciate the legal parameters set for the review of rents in commercial leases;
- explain and evaluate the way in which statute protects the occupation of tenants of business premises;
- identify and analyse potential legal rights and liabilities arising out of complex hypothetical scenarios;
- organise and deploy legal material concisely and effectively in writing.
- demonstrate self direction in tackling and solving problems;
- act autonomously in formulating legal advice on contractual and landlord and tenant issues.

Additional outcomes:
Students will be encouraged, through guided discussion, further to develop their oral communication skills and their effectiveness in group situations.

Outline content:

• Legal principles governing the formation of contracts (including sales of land) and liability for breach of contract and for misrepresentation • a brief outline of the basic principles of English property law • leases, licences and the enforceability of leasehold covenants; • the principal lease covenants; • remedies for breach of lease covenants; • termination of leases; • rent reviews; and • statutory protection of business tenants.


Brief description of teaching and learning methods:
The course will be delivered as a block release with on-line course support. The block release teaching will comprise 4 1/2 days of lecture and problem solving workshops. Two individual project assignments will serve to consolidate and integrate the taught material.

The block release taught element will be supported by the use of Blackboard. The course information, handouts, presentations and assignment will be posted here.

Other information on summative assessment:

The module will be assessed by way of two assignments. These will require students to consider a hypothetical scenario, to identify the legal issues arising there from, and to suggest possible legal outcomes. A strict word limit of 2500 words applies to for the first assignment and one of 3500 to the second. The first assignment is weighted 40%; the second assignment is weighted 60%.

Reassessment arrangements:
New assignment for any failed assignment - this will achieve a maximum mark of 50%
Reassessment will be by the same method as for the module's original assessment requirements, subject to variation by the Examination Board where appropriate
