Regulations relating to Novel Foods
The letter is to announce that two new Regulations came into force on the 16 June 1997. They are the Novel Foods and Novel Food Ingredients Regulations 1997 (SI 1997 No 1335) and the Novel Foods and Novel Food Ingredients (Fees) Regulations 1997 (SI 1997 No. 1336). The Regulations apply to England , Wales and Scotland.
The first set of Regulations provide for the enforcement and execution of certain specified provisions of Regulations (EC) No 258/97 concerning novel foods and food ingredients. In particular, they:
- designate the Minster of Agriculture, Fisheries and Food and the Secretary of State for Health to act jointly as the food assessment body in Great Britain for the purposes of Regulation 258/97;
- appoint food authorities to enforce and execute the provisions of Regulations 258/97 and of the UK Regulations;
- specify certain provisions of Regulation 258/97 and establish penalties for contravening those provisions.
The second set of Regulations establish a scale of fees to be paid to the Minster when, in accordance with his duties under Council Regulation 258/97 and the UK Regulations (1997/1335) he processes requests to assess novel foods and novel food ingredients.
