SUPPLEMENTS/FORTIFICATION – FSA Update: The Food Supplements (England) and Addition of Vitamins, Minerals and Other Substances (England) (Amendment) Regulations 2009

I refer to the public consultation undertaken by the Food Standards Agency (FSA) between 28 September and 9 November 2009 on a draft of the above regulations and my letter of 10 December [see UK News 10 December 2009] advising you of the publication of the summary of responses to the consultation on the FSA website and enclosing a copy of the summary for your information.

You will wish to be aware that the Food Supplements (England) and Addition of Vitamins, Minerals and Other Substances (England) (Amendment) Regulations 2009 have been published as SI 2009/3251 and are available on the Office of Public Sector Information website at: http://www.opsi.gov.uk/si/si2009/pdf/uksi_20093251_en.pdf.

As you will be aware from the consultation documents and summary of responses, the regulations will implement the amendments that European Commission Regulation (EC) No. 1170/2009 will make to the Food Supplements Directive 2002/46/EC and Regulation (EC) No. 1925/2006 on the addition of vitamins, minerals and certain other substances to foods. They will also make several necessary amendments identified by the FSA during the consultation, as outlined in the summary of responses. The regulations will come into force on 1 January 2010, as will separate, parallel, regulations in Scotland, Wales and Northern Ireland.
