IMPORT CONTROLS - Commission Regulation (EC) No 669/2009 as regards the increased level of official controls on imports of certain feed and food of non-animal origin (non-POAO)) and amending Decision 2006/504/EC

Further to my letter of 14 December [See UK News Item: 14 December 2009] I am writing to inform you of publication of (i) The Official Feed and Food Controls (England) Regulations 2009 (SI 2009 No. 3255) and (ii) food business operator and enforcement officer guidelines

Official Feed and Food Controls (England) Regulations 2009 (S.I 2009/3255)

The Regulations for England will come into force on 25 January 2010. The new Regulations, which revoke and replace the Official Feed and Food Controls (England) Regulations 2007, have been made primarily to give effect to enforcement provisions, in England, for Regulation (EC) 882/2004 on official feed and food controls and Regulation (EC) 669/2009 as regards the increased level of official controls on imports of “high-risk” non-Products of Animal Origin (non- POAO) feed and food. The Statutory Instrument (SI 2009 No. 3255) has been published on the OPSI website at: www.opsi.gov.uk/si/si2009/pdf/uksi_20093255_en.pdf. Parallel legislation will be enacted in Scotland, Wales and Northern Ireland.

Guidance notes

In parallel with publication of the SI, the Agency has prepared guidance notes on the new requirements. The guidance for (i) feed and food businesses operators and (ii) feed and food enforcers provides informal non-statutory advice and should be read in conjunction with the SI, Regulation (EC) 882/2004 and Regulation (EC) 669/2009.
